Immigration verified
At a 2015 Palm Sunday refugee rally Gallagher expressed discomfort with offshore detention, telling Fairfax Media 'I am uncomfortable with what is going on now' and that few Australians, 'if they fully understood what was going on in detention centres and offshore processing, would be that comfortable with how it is being conducted.'
Citizenship (s44 eligibility) verified
Gallagher held British citizenship by descent through her father; her renunciation was lodged in April 2016 but not registered by the UK Home Office until 16 August 2016, after she nominated for the 2016 election. On 9 May 2018 the High Court unanimously ruled her ineligible under section 44(i); she returned to the Senate at the 2019 election.

Voted against the second reading of the Human Rights Legislation Amendment Bill 2017, which proposed replacing 'offend, insult, humiliate' with 'harass' in section 18C of the Racial Discrimination Act (Senate, 30 March 2017; Ayes 32, Noes 29). Voted against Schedule 1 of that bill standing as printed, the provision making the substitution; the Schedule was negatived and the change did not proceed (Senate, in committee, 30-31 March 2017; Ayes 28, Noes 31).
